Pictureworks International Holding Limited and any of its subsidiaries, related and/or affiliated companies (together and/or individually referred to as “Pictureworks”, “us” or “we” or “our”) committed to safeguarding and protecting the personal data of our customers, vendor, suppliers, service provider, visitors, and contractors (collectively, “data subject”, “you” or “your”) that have been provided to us.
This Privacy Notice is established to provide a better understanding of our policies and procedures regarding the collection and processing (as defined in the Personal Data Protection Act 2012) of your personal data which you have provided to us and/or we possess about you. We use reasonable efforts in accordance with industry best practices to ensure and maintain confidentiality of your personal data and are restricted from using your personal data for any unauthorised purpose.
1. COLLECTION OF PERSONAL DATA
1.1 “Personal Data” means any personal information which you have disclosed to us as defined under the Personal Data Protection Act 2010 which can be used to identify you or from which you are identifiable. This includes but is not limited to your name, nationality, telephone number, bank and credit card details, personal interests, email address, your image, government-issued identification numbers, biometric data, race, date of birth, marital status, religion, health information, employment information and financial information. Personal Data is provided on a voluntary basis. However, if such Personal data is not provided, we may not be able to communicate with you or render any services as contracted.

(d) payment information for example: credit or debit card information, including the name of cardholder, card number, card issuing bank, card issuing country, card expiry date and banking account details; and

Some of the personal data that we collect may be sensitive in nature (for instance, your race, religious belief, background information including financial and criminal records, health data, disability, marital status and biometric data). 2.1 We may use and process the Personal Data for the purposes connected with providing services as requested by you or for business activities which shall include, but not limited to:
(a) process your requested services;

This includes information that you provide when you register to use our site, participate in social media functions, enter a competition, promotion or survey, including when you report of problem via our website or mobile application;
(i) prevention, hindrance, reporting of any criminal activities including but not limited to fraud, bribery and/or money laundering;
(j) utilizing of personal data for any future marking or promotional purpose; and
(k) any other purposes as and may be required under the relevant law and legislation

3. DISCLOSURE OF PERSONAL DATA
3.1 We may disclose your Personal Data to:
(a) other subsidiaries, related and/or affiliated companies;
(b) information technology or data entry service providers;

(d) financial institutions and insurance service providers;
(e) business professional advisors and external auditors; and
(f) payment network operators and credit card verification providers, governmental agencies, regulatory authorities, if and when required
3.2 You may receive marketing communication from us or from the abovementioned entity about products and services that may be of interest to you. If you no longer wish to receive these marketing communications, please notify us to withdraw your consent and we will stop processing and sharing your Personal Data with these other entity for the purpose of sending you marketing communication.
3.3 You may withdraw your consent to receive marketing or promotional materials/communications by contact us using the contact details provided herein. Please be aware that once we have received confirmation that you wish to withdraw your consent for marketing or promotional materials/communication, it may take up to fourteen (14) working days to reflect your withdrawal in our system. Therefore during this period of time you may still receive marketing or promotional materials, we may still contact you for other purposes in relation to the accounts, facilities or services.
3.4 We will not disclose your Personal Data to unaffiliated third parties without your consent unless such Personal Data is required by law or in good faith and such action is necessary to comply with any law enforcement agency requirements, court orders or legal processes. 4.1 We use "cookies" (small files placed on your hard drive) on certain of our pages in our website to help analyse our web page flow, customise our services, content and advertising, measure promotional effectiveness, and promote trust and safety.

Once your Personal Data is no longer necessary for the purposes, or we no longer have a legal or business purpose for retaining your Personal Data, we take steps to erase, destroy, anonymise or prevent access or use of such Personal Data for any purpose other than compliance with this Privacy Notice, or for purposes of safety, security, fraud prevention and detection, in accordance with the requirements of applicable laws.
6. SECURITY
Your information is stored on our servers located in Singapore. We treat data as an asset that must be protected using tools (encryption, passwords, physical security, etc.) to protect your personal information against unauthorised access and disclosure. However, as you probably know, third parties may unlawfully intercept or access transmissions or private communications, and other users may abuse or misuse your personal information that they collect from our website. Therefore, although we work very hard to protect your privacy, we do not promise, and you should not expect, that your personal information or private communications will always remain private.
7. PROVISION AND SUPPLY OF PERSONAL DATA

8.2 In respect of your right to access your Personal Data, we endeavour to provide you with an adequate means of accessing it. We reserve the right to impose a fee for fulfilling your request for access of your Personal Data in the amounts as permitted by the applicable law.
8.3 There may be instances where we cannot grant you access to the Personal Data we hold. For example, we may need to refuse access if granting access would interfere with the privacy of others or if it would result in a breach of confidentiality or law. In that event, we will provide you written reasons for any refusal.
9. LEGAL EFFECTS
9.1 APPLICABLE LAW AND DISPUTE RESOLUTION
This Privacy Notice shall be governed by and construed in all respect in accordance with the laws of Singapore. Any controversy, claim or dispute arising out of or relating to this Privacy Notice and/or the breach, termination or invalidity thereof shall be referred to and resolved by a court of competent jurisdiction in Singapore.
